KO client Terma Software, which provides solutions for enterprise workload automation, was recently acquired by Broadcom Inc. (NASDAQ: AVGO), a global technology leader for semiconductor and infrastructure software solutions, for an undisclosed amount.
Terma’s acquisition will enhance Broadcom’s Automation.ai platform by adding new workload intelligence and analytics sources and enabling actionable insights from numerous vendors. Terma’s solutions improve operational efficiency in real time by modeling workload dependencies, optimizing workloads, enabling intelligent software license agreements and more.
KO began working with Terma in 2006, and has advised Terma for more than 13 years on commercial matters such as negotiating software license agreements and service level agreements with enterprise businesses, as well as corporate matters in recent years.
“KO has been a long-time, trusted advisor to Terma Software on complex commercial and strategic corporate matters,” said Shane Hade, CEO of Terma Software. “KO’s experienced team has guided us through the complete business lifecycle: from an emerging technology company through significant growth to the successful completion of our acquisition.”
Terma’s exit was led by Hade and Cathleen Fellows, VP of Business Operations. KO partner John Gaddis and attorney Samantha Pjesky represented Terma in the acquisition, and several other members of the KO team have worked with Terma over the years, including KO partners Ben Oelsner and Dan Fredrickson.
“It’s very rewarding to work with a client like Terma Software through all the phases of a company’s lifespan,” said Gaddis. “We’re able to see the results of strategic legal and business decisions that are made in the course of a longstanding relationship, and we’re proud to have helped Terma achieve one of its most significant business goals with this acquisition.”
